The state investigators determined that the nursing home “failed to prevent witnessed sexual abuse to [one resident by another resident] and unwitnessed sexual abuse to [two other residents by the same sexually assaulting resident].”
A review of the sexually inappropriate resident’s Behavior Tracking Sheet documents that this resident “had three behaviors of nonconsensual kissing” involving three other residents. A review of the resident’s Brief Interview for Mental Status (BIMS) indicates there was “no cognitive impairment, no delusions or hallucinations, uses a walker and wheelchair, and requires staff supervision after staff set up for locomotion on the unit.”
It was documented that on December 26, 2018, just after lunchtime, the inappropriate resident kissed another two other residents the day before (Christmas Day) “without permission and probably kissed [these three residents before Christmas Day], without permission.”
The assaulting resident stated as far as kissing the three other residents, “I probably did. That is just me. I am very friendly, that is it.”
Failure to Ensure the Nursing Home Area Remained Free of Accident Hazards and Risks and Provides Supervision to Prevent Avoidable Accidents – citation #F323 date June 15, 2017
The facility “failed to thoroughly investigate, implement interventions, report a fall with injury to the State Survey Agency, and update Care Plans post falls for [three residents].” A review of one resident’s Fall Risk Assessment documented that this resident “is at high risk for falls.”
A review of the facility’s Fall Logs documented that the resident “had falls occurring on July 20, 2016, and May 14, 2017. Those logs do not document [the resident’s] fall that occurred on March 3, 2017, per [the resident’s] SBAR (Situation, Background, Assessment, Recommendation).”
It was also noted that “there is no documentation of [the resident’s] fall that occurred on July 20, 2016, in [the resident’s] medical records.” The resident’s “care plans do not document any new post-fall interventions placed after [the resident’s] fall on July 20, 2016.” This failure was confirmed by the Director of Nursing, who stated that the resident’s care plans “were not updated with an intervention for this fall.”
