Failure to Follow Basic Standards of Care That Jeopardized the Health and Well-Being of a Resident at the Facility

In a summary statement of deficiencies dated 05/13/2015, a complaint investigation was opened against the facility for its failure to “provide a therapeutic diet that takes into account the resident’s condition for [the resident] assessed required a puréed diet.” This complaint investigation involved a deficient practice for a resident identified “as having swallowing abnormalities [… and a] plan of care indicating the resident requires assistance with meals [who] eats in the Lounge Dining Room.”

During a dinner meal “The resident was brought to the main dining room by the occupational therapist. The resident’s plate was dished up with a regular texture diet by the cook, and the plate was served by the Dietary Aide. The meal consisted of a hotdog and American fried potatoes. Neither the cook nor the dietary aide looked at the meal ticket to identify the resident’s meal texture order. The resident ate the regular textured food, choked on the food, required [a specific] maneuver, became unresponsive, was intubated by paramedics and had a cardiorespiratory arrest. The resident was admitted to the hospital.” The neurology consult indicates that the resident has a poor prognosis for recovery or survival.

In a summary statement of deficiencies dated 10/01/2015, a notation was made during an annual licensure and certification survey by a state investigator concerning the facility’s failure to “ensure that it operationalized [its] policy/procedure related to abuse and misappropriation when conducting a completed background check for [3 employees including a Certified Nursing Assistant (CNA), Recreational Assistant (RA) and Recreation/Volunteer Coordinator (RC-M).”

Additionally, the deficient practice was noted because of the facility’s failure “to perform a complete background check on a current employee (CNA) at the time of hire, did not conduct the four year checks for (both the Recreational Assistant and the Recreation/Volunteer Coordinator) and the facility failed to verify the four year background check of current contracted employees.”

“This deficient practice has a potential to affect more than a limited number of residents [who may or may not come in contact with all three employees].”

Failure to Provide Proper Assessment and Documentation to Show a New Pressure Sore Exists or Adequate Treatment to Ensure an Existing Bedsore Heals Properly

In a summary statement of deficiencies dated 04/06/2015, a notation was made by a state surveyor during an annual licensure and certification survey involving the facility’s failure to “ensure that [a resident] who developed a pressure ulcer that went unreported received the necessary treatment and services.” The deficient practice was noted because a resident “was observed with a stage II pressure ulcer on her right buttock. The CNA (Certified Nursing Assistant) did not report this to a licensed nurse and the facility was unaware that the area had been reopened until it was brought to their attention by the surveyor.”

Failure to provide minimal standards of care to ensure that existing pressure sores are brought to the attention of the proper authorities might be considered negligence or mistreatment of the resident. Failure to Administer Drugs as per Ordered by the Doctor Which Increased the Potential of Placing the Resident’s Health in Jeopardy

In a summary statement of deficiencies dated 10/17/2015, a state surveyor made a notation during an annual licensure and certification survey concerning the facility’s failure to

ensure that it provided pharmaceutical services to meet the needs of [2 residents].” The deficient practice was noted after observation that a resident “received an order on 08/05/2015 for Remeron 7.5 milligrams. [However,] this order was not picked up and [the resident] never received the medication which was discontinued on 08/20/2015.” In a separate incident, another resident’s physician telephone order to discontinue clonazepam 0.5 milligrams at bedtime and administer this medication PRN was not transcribed onto the monthly physician order.

Failure to Properly Report or Investigate an Allegation of Abuse of a Resident at the Facility

In a summary statement of deficiencies dated 11/05/2015, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility’s failure to “report all allegations of abuse and/or neglect to the facility administrator immediately and or initiate an investigation is required” concerning to self-reported incidences at the facility. The deficient practice was noted in response in part of a review of self-reported investigations” alleging verbal abuse and because it indirectly affected 22 residents at the facility. The incidences were never reported to the facility administrator at the time of the incident on 07/12/2015. “An investigation into this allegation was not initiated until 07/17/2015.”

Failure to report or investigate any act or report of alleged abuse of residents directly violates state and federal regulations and is not in compliance with the adopted policies at the facility. This deficient practice could be considered negligence or abuse of residents in the eyes of the law.
