- Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 date February 21, 2019
The state investigators determined that the nursing home failed to prevent rough treatment during care for [one resident].” The incident involved a resident who “currently resides on a locked dementia unit and has resided in the facility about five years.”
The state investigators interviewed the resident’s daughter via the telephone at 1:00 PM on February 19, 2019, regarding the resident’s care. The daughter told the investigators that “she has a video of the care provided to her mom from February 1, 2019, to February 11, 2019.”
The daughter “confirmed that she had not provided the video to the facility nor had she spoken anyone at the facility about this.” The facility Administrator “was informed of the allegations of mistreatment on February 19, 2019, at 1:52 PM. The facility took immediate corrective actions to include assessing the resident, suspending the identified Certified Nursing Assistants (CNAs), completing a Federal Immediate Report, notifying the abuse hotline, and initiating an investigation.”
A review of the video shows a Certified Nursing Assistant (CNA) standing beside the resident’s bed, assisting the resident with eating. The resident “pushes the employee’s hands away [who then picks up the resident’s] right wrist with a tight grip and appears to push [the resident’s] hand toward her face.” The resident “then left the room, and the resident continued to feed herself.”
The CNA denied “pushing the resident’s arm toward her face.”
