The state investigators determined the nursing home "failed to implement their Abuse Policy and Procedure for investigation of an allegation of resident-to-resident abuse between [two residents]. This failure had the potential for continued abuse to occur.”
The Director of Nursing stated that “she acknowledged that [neither] she nor any other staff member completed an investigation regarding an incident between two residents on April 1, 2019, at 4:35 PM in the dining/activity room.” The Director also acknowledged that no investigation report into the allegation of abuse was submitted to the State as required within five days.
The “facility failed to thoroughly investigate an abuse allegation and protect other residents from abuse and prevent mistreatment of [residents].” Specifically, an abuse allegation “was not thoroughly investigated or reported and witness statements were not taken when [a resident] claimed to be mistreated by staff. This [failure] had the potential for the alleged abuse to not be promptly investigated and therefore an inaccurate conclusion determined, allowing the perpetrator to continue to abuse residents.”
A Registered Nurse (RN) “was not suspended pending abuse investigations in order to prevent further abuse from occurring. This [failure] had the potential for the alleged abuser to continue to abuse the same resident or others.”
It was determined by the nursing staff that the Registered Nurse “was not trained in abuse when hired and was not able to state what abuse was or how to report it. This [failure] resulted in the RN not being able to identify what abuse was or how to report, as well as not knowing residents have the right to refuse care, resulting in the resident becoming very upset and wanting to leave the facility.”
