  • Failure to Protect Every Resident from All Forms of Abuse, Physical Punishment, and Being Separated from Others – citation #F223 date January 9, 2018
  • The state investigators determined the nursing home "failed to prevent staff from treating [one resident] in an abusive manner, when [an unlicensed staff member treated the resident] in a physically and mentally abusive manner. This failure resulted in [the resident] being in pain. The treatment left [the resident] in shock about being treated in an abusive manner by staff.”

The survey team interviewed the complainant who said that the female resident “had reported being treated roughly by staff on the morning of October 14, 2017.” The complainant said that the resident had said that “the incident had occurred the previous night shift.” It was reported that the unlicensed staff member “had hurt her and treated her rough in the process, when changing her wet brief (adult undergarment).”

The complainant said that the resident had told her that the unlicensed staff member “had thrown her around on the bed and had caused [the resident pain].” The investigators interviewed the resident who stated that the unlicensed staff member “kept throwing me back and forth on the bed when changing her brief.” The resident said that “she had cried out in pain and told [the staff member], ‘you are hurting me.’”

The resident said that the staff member “threw me this way and threw me that way and [she had] been in pain during the incident.” The resident said that “she had been shocked about the way she had been treated and stated, ‘I just could not believe it.’”

A second resident said that when entering the bathroom without assistance, she “overheard parts of the interaction and conversation between [the injured resident and the unlicensed staff member].” She said that “she heard the [unlicensed staff member speak harshly] to the resident and then heard the resident crying out in pain.”

The second resident said that the injured resident repeatedly said, ‘ouch, ouch, you are hurting me,’ and ‘why are you doing this to me?’ A management staff member said that the reporting resident told her the unlicensed staff member treated the injured resident “like a slab of meat.”

Jonathan did a great job helping my family navigate through a lengthy lawsuit involving my grandmother's death in a nursing home. Through every step of the case, Jonathan kept my family informed of the progression of the case. Although our case eventually settled at a mediation, I really was impressed at how well prepared Jonathan was to take the case to trial. Lisa

After I read Jonathan’s Nursing Home Blog, I decided to hire him to look into my wife’s treatment at a local nursing home. Jonathan did a great job explaining the process and the laws that apply to nursing homes. I immediately felt at ease and was glad to have him on my side. Though the lawsuit process was at times frustrating, Jonathan reassured me, particularly at my deposition. I really felt like Jonathan cared about my wife’s best interests, and I think that came across to the lawyers for the nursing home. Eric
