  • The state investigators determined that the nursing home “failed to implement written policies and procedures prohibiting and preventing abuse/neglect of residents.” This deficient practice included a failure “of staff to immediately report allegations of abuse related to [two residents] with the potential to affect all residents. Staff education had not occurred following the incident.”

    The state investigators reviewed a closed record of a male resident. Before his death, “he was receiving hospice services. He required total assistance with activities of daily living. He was not able to speak. However, he could nod/shake his head to indicate yes or no.”

    The Physician’s Progress Note, dated January 10, 2019, revealed that the resident “was doing poorly. It indicated, he is now in a fetal position and is not speaking much. He gets agitated once in a while and does start to talk then, but most of it is nonsensical.”

    The resident had been seen for wound care, and changes had been made to his treatment. The resident was in pain due to multiple medical conditions and was receiving drugs around-the-clock.

    A Certified Nursing Assistant documented that “she had witnessed an incident of alleged abuse of [the resident]. In her statement, she stated that she stayed over until 4:45 PM to help [a CNA].” When she entered the room after knocking, the other employee inside the resident’s room said to her, “you did not see a thing.”

    The CNA indicated that the other Certified Nursing Assistant had a small cup and spoon in her hand and was attempting to “administer [the resident’s] pain medication by spoon, but he refused to open his mouth. She pinched his nose closed to try to get him to open his mouth. He fought back and refused to open his mouth.”

    The CNA stated “[the other CNA] had attempted to force a plastic spoon into [the resident’s] mouth, but she was unable to do so.”
