The state investigators determined that the nursing home “failed to protect residents from abuse.” Documentation shows that the nursing staff is to seat the resident near the staff members at the nurse’s station “to allow the opportunity for socialization and monitor mood changes. If [the resident] is engaged in physical abuse or behaviors being aggressive toward staff members, remove from harming others.”
Other documentation, including a Care Plan, shows that the severely, cognitively impaired resident “is known to display/has a history of physical and verbal aggression toward staff and individuals.” The documentation shows that “verbal aggression could lead to physical contact” and that the resident “experiences hallucinations and delusions.”
The Incident Report dated June 14, 2019, showed that there was an alleged resident-to-resident altercation between two residents. The staff immediately separated the residents but “scratches were noted on [one resident’s] buttocks and face.”
A Certified Nursing Assistant (CNA) stated that at approximately 7:05 PM, “I just walked up to the CNA desk and heard someone start yelling. As I was making my way to the front foyer, I saw [two residents] engaged in a physical altercation. By the time I could get to them, they both fell to the ground.”
A few days later at 10:00 AM, one of the residents “was pacing the halls and talking to himself.” The staff was “unable to comprehend what [the resident] was saying.” The resident said, “I broke it, but I did not.” The resident asked a member of the staff if “I wanted to fight and I said, ‘No.’”
Even with an attempt to redirect the resident, the resident then grabbed the staff member “from behind and knocked [them] to the ground.” When the staff member was “attempting to get up, [the resident] kicked him in the head.” Another physical altercation occurred at 1:10 PM that day when the resident latched onto the other resident from behind “like a bear hug.” Two Certified Nursing Assistants “came and yelled at them to stop it and separated [the two residents].”
