- Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 date November 30, 2018
The state investigators determined that the nursing home “failed to ensure [a difficult resident’s] behaviors were monitored, and [the resident] remained free of physical abuse.”
The investigation involved a review of evidence and a Certified Nursing Assistant (CNA) stated: “I was working the day shift, and it was after lunch, and I was trying to assist residents out of the dining room.” The resident “was in the doorway of his room, yelling loudly and repetitively ‘CNA, CNA.’ I know that [the resident] likes to go to the bathroom after lunch, so I went to his room and assisted him to the bathroom with his walker.”
The CNA stated, “I gave him his oxygen, the whole time he was yelling. I think he was mad; something about [the shower aide] was not giving him a shower yet.” The resident “was yelling loudly how awful we (the staff) are and then started yelling at me. He told me I was a worthless piece of s**t.”
The Certified Nursing Assistant stated that “on instinct, I turned around and struck him across the face. I told them I was going to get someone else and he told me, ‘I hope you hit me harder next time.’ I went to get [another CNA] and told her I could not care for [a resident] anymore.”
The CNA stated, “I was so angry with him. I was stressed and lost my temper with him. He was yelling repeatedly. [The resident] across the hall was yelling at [the resident] to shut up. It was chaotic; everyone was disturbed. I was doing the best I could to get everything done. It is yelling at me [that] brought up feelings of when in my old relationship, my ex-husband called me a dumb b***h and everything else. It brought back old feelings.”
The Certified Nursing Assistant stated that “apparently [the resident] did not report the incident to [the Administrator] that day, as I did not hear anything further.”
