The state investigators determined that the nursing home “failed to keep [the resident] free from mental abuse by [a staff member].” The state investigators reviewed the facility’s Final Incident Report.
The report indicated that a Certified Nursing Assistant (CNA) “made a video recording of [the resident’s] worsening mental condition using a social media site application on her smartphone.” The CNA “sent a video recording via a social media application to [a family member].”
A Registered Nurse (RN) reported that “her daughter [the family member who received the video recording] received a disappearing video from [the CNA showing the resident] in her room. The facility determined that the allegation of abuse was founded and [the CNA] was terminated from her employment with the facility.”
In a separate summary statement of deficiencies dated March 7, 2019, the “facility failed to ensure residents are free from physical abuse.” The facility’s Initial Report showed that two residents “were reported to have a physical altercation.”
In this case, the resident “stated they backed out of the phone room in their wheelchair.” The resident stated a second resident “was walking in the hallway.” That resident “yells, ‘Stop calling my family for money and talking to the cops!” The verbally aggressive resident “picked up a walker and swung at me. I put my hands up to block the walker. Part of the walker hit me in the chin. I covered up, and he hit me in the back on my right shoulder.”
The investigators asked the aggressive resident about the incident. That resident stated, “there was a fight. He was mad and could not remember why he was mad. At this time, [the aggressive resident] became agitated and walked away from the surveyor.”
A Registered Nurse (RN) stated “I was in the hallway of the medication cart. [The resident] started yelling down the hall.” Two residents “were near the phone room door.” The aggressive resident “picked up his walker and showed [the other resident].”
The aggressive resident then “dropped the walker, swung with his hands at [the assaulted resident and hit that resident] in the back.”
