  • The state investigators determined the nursing home "failed to ensure each resident was free from sexual abuse for [one resident] when on two separate occasions (March 25, 2019, and April 3, 2019) [the resident] without permission, grabbed [another resident’s] breast in the hallway of the facility.”

    For the assaulted resident, “the facility failed to protect her from sexual abuse from [the other resident] on April 3, 2019, ten days after a previous incident of sexual abuse occurred on March 25, 2019, with [the same resident]. This failure had the potential to impact the physical and mental well-being of [the female resident] by increasing her anxiety and depression from potential feelings of disrespect and violation of her personal body space.”

    The state investigative team observed the assaulted female resident in the dining room being spoken to in Spanish by a Certified Nursing Assistant (CNA) assisting her “with her lunch meal.” The resident “did not engage in conversation with the CNA.”

    Six minutes later, the surveyors observed the sexually assaulting resident “sitting in bed with the head of the bed elevated up.” The CNA interpreted for the resident in Spanish where the resident “stated what his name was.” The resident stated that “he did not know who [the assaulted female resident] was.” The male resident “did not know what happened on April 3, 2019.”

    Another CNA had stated that “at approximately 11:20 AM, she was walking to the B Hall when she saw [the male resident grab the female resident’s] breasts from behind.” The CNA stated that the female resident “was directly outside her room in the hallway at the time of the incident.”

    The CNA said that the male resident “was in his wheelchair behind [the female resident] when he reached around and grabbed her breasts.” The CNA stated that the male resident let go of the female resident when he saw the CNA. The CNA said, “she separated the residents immediately and reported the incident to the Charge Nurse.”
