  • Failure to Attempt Various Approaches before Using a Handrail to That Could Cause Entrapment Without Informed Consent - citation date February 2, 2018

  • According to investigators, the facility "failed to attempt appropriate alternatives, assess for risk of entrapment, review the risks and benefits and obtain informed consent [before] installing side rails on all residents' bed." The deficient practice affected 38 residents that could experience a potential accident related to the use of side rails.

    The investigators conducted an initial tour the facility in January 2018 and saw "the presence of side rails attached to 224 of the facility's 227 total beds. The three beds without side rails were unassigned to any residents."

    During interviews conducted at the Ventilation Nurse's Station, it was revealed that "facility side rails are never removed from any resident beds. Side rails remain attached all beds. At admission, residents are not assessed for alternatives to side rails [before] being assigned to bed with the side rail already attached."

    The survey team reviewed medical records for all affected residents that revealed "no documented evidence of appropriate alternatives for side rail use were tempted [before] being assigned to a bed with side rails already attached. No review of medical records contained an assessment for the risk of entrapment [before] being assigned to bed with side rails already attached. There was no documented evidence in any reviewed medical record of the benefits versus risk analysis [being completed before] assigning a resident to side rail attached beds.

  • Failure to Protect Each Resident from All Forms of Abuse, Physical Punishment or Being Separated from Others - citation date February 2, 2017

  • The facility "failed to ensure one resident was free from physical, verbal and emotional abuse." The surveyors determined "that a situation in which the facility's noncompliance with one or more requirements of participation had caused, or had the likelihood to cause, serious injury, harm, impairment or death to residents."

    The incident occurred on November 30, 2016, at approximately 5:00 PM when the resident told a Licensed Practical Nurse (LPN) "that he was not going to take any more insulin that day. However, [the LPN] entered the resident's room at approximately 9:00 PM [that evening], snatched the sheet off his head, held the resident's left arm/hand behind the resident's back and administered the insulin."

    The resident reported the alleged abuse on that day. However, "the facility failed to protect the residents, and the facility continued to allow [the LPN] to work until December 28, 2016. The facility failed to investigate the event [and] notify the State agency as required, and the facility failed to follow their policy titled: Abuse Prevention Program and Reporting Policy."
