The state investigators determined that the nursing home “failed to develop a policy and procedure that ensure staff are not taking or using photographs or recordings that would demean or humiliate residents. This [failure] has the potential to affect all fifty residents living in the facility.”
The state investigators reviewed the facility’s policies and procedures and found “there was no policy prohibiting staff from taking or using audiotape, videotape, or photographs of residents that would demean or humiliate residents.” This failure was verified by the Administrator, who stated, “there was no policy and procedure in place.”
The facility “failed to provide adequate supervision and implement measures to reduce the risk of injury for [six residents].” A nursing note dated February 27, 2019, documents the resident “taking shirt off [and] keeps going into other residents’ rooms.” The wandering resident was “reaching over the nurse’s desk and taking items from the desk.”
The note from the following day indicated that the resident was “in the dining room, picked up a chair, and was swinging a chair over his head. [Two staff] were able to get the chair away from [the resident and then took the resident] to the table several times.”
A few hours later, a nursing note indicated that a CNA attempted to change [a resident] and he twisted her arm behind her back [and] will be re-approached later.” By March 13, 2019, the Nurse’s Notes indicated that the resident “is very upset, almost crying, and has that look in his eyes that tells us to get back and give [the residents] space.”
The nursing staff attempted to give the resident medicine, but the resident kept refusing. By May 17, 2019, it was documented that the resident was “up at the nurse’s station. [The resident] was talking continuously when [another female resident] walked over and stated, ‘Why don’t you shut up.’” The resident “got upset and [pulled his] arm back. [Another staff member] walked over to remove [the resident] who started cursing and chasing the nurse to the nurse’s station.”
