  • Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 December 13, 2018
  • The state investigators determined that the nursing home “neglected [a resident] by failing to ensure nursing staff provided the necessary oversight to direct care staff during the breakfast meal.” The investigation involved one resident “requiring supervision or assistance with meals.”

    The resident “was known for obtaining and eating food of the texture that was not compliant with her diet order, which was puréed. The breakfast trays for both [the resident] and her roommate, who was on a mechanical soft diet, were delivered to [the residents’] room.”

    The injured resident “was allowed to remain in the room alone, unsupervised and was found nonresponsive, without breath or pulse. The staff was able to eject chunks of the roommate’s mechanical soft meal from her throat during compressions in a procedure described as a modified [Heimlich] maneuver.”

    The resident “had been identified by the Speech Therapists as needing 100% supervision at meals to remain safe.” The Registered Dietitian provided a purée diet “due to [the resident] being a compulsive eater who did not like purée consistency of food and was known to take food off other residents’ trays.”

    The resident’s medical records indicated that the resident had “an Impulse Disorder and was to be discouraged from taking food off other residents’ trays.” Interventions include monitoring the resident during mealtimes.

    It was determined that “the facility’s failure to provide the necessary oversight of nursing staff to ensure [the resident] was not provided with an opportunity to obtain a breakfast of foods not in compliance with her diet, failure to file their policy, and failure to follow their professional staff’s recommendations and [the resident’s] Care Plan, represented a failure and put [the resident] at high risk of aspiration and death.”

    This failure also “had the potential to affect other residents that require assistance and supervision during meals.”
