The state investigators determined that the nursing home “failed to ensure the reporting component of the facility’s Abuse Prevention Policy was implemented. The facility failed to report allegations of abuse within the two-hour time frame specified in their policy.”
This deficient practice “was evident in three of eleven of the facility reported incidents reviewed for reporting requirements.” The Confirmation of Receipt of Ongoing Incident Report submitted to the State agency on January 12, 2018, at 6:00 PM, arrived “nine hours after the facility witnessed the incident of verbal abuse” in violation of state and federal rules and regulations.
Another Facility Reported Incident “documented an allegation of verbal abuse that occurred on January 23, 2018, at 5:30 PM.” The facility investigation indicated that the resident “was in the dining room for supper [when he/she] became irate because he/she was asked to wait just a few minutes to be served his/her meal.”
A nurse assigned to the dining room attempted to redirect the resident who “got louder and started cursing at the staff.” Another resident “was seated across the dining room from the other resident and became upset about the language the other resident was using toward the staff.” Then, the aggressive resident “directed his/her anger toward [the vocalizing resident]. Both men/women were standing and using profanity.”
A witness statement indicated that at approximately 5:30 PM on January 23, 2018, “I heard shouting coming from the dining room. I entered the dining room to see two residents screaming and cursing at each other from across the room.” The Confirmation of Receipt of Online Incident Report concerning this incident submitted to the State agency occurred at 10:28 AM on January 24, 2018. The time it arrived was “approximately seventeen hours after the facility staff witnessed the incident of verbal abuse.”
A third incident involving an allegation of verbal abuse was documented in the facility reported incident log occurring at 1:39 PM on January 24, 2018. This incident was reported at 9:42 AM on January 25, 2018, “more than twenty hours after facility staff witnessed the incident.”
