The state investigators determined that the nursing home “failed to thoroughly investigate and report to the department an injury of unknown origin, allegations of potential abuse involving [a staff member], allegations of abuse involving [a resident], and grievances/complaint reports filed for [two residents].”
For one resident, the Nursing Notes indicated the resident had bruises to the left upper arm measuring 5.0 cm x 1.5 cm and a red area with a small multiple abraded area noted by staff.” The document shows that the husband was not aware of any trauma but that the resident is not oriented and confused.
The CNAs signed a written statement indicating that “they have observed her spouse grabbing her arms with the attempts to stand up out of the chair or wheelchair. They do not recall her injuring herself to cause discoloration.” The Certified Nursing Assistants state that the spouse “sits her down like that frequently.”
The Director of Nursing stated “I assume the husband caused the bruising because I have seen him grab her arms. The bruises look like hand and fingerprints. When questioned if she interviewed other residents and staff to rule out abuse, [the Director] stated, ‘no, I assumed it was the husband and did not investigate any further.”
In a separate incident, a male resident’s Nurse’s Note indicates that the resident “is touching on women on the way to his seat for meals.” One resident stated that “he rubbed on my back and shoulders and tried to touch my chest.”
A review of the resident’s Behavior Monitoring Record documents that the resident “undressed [himself] and walked down to breakfast naked and rubbed a female resident’s shoulders on the way to breakfast.”
The facility Administrator stated that the incident involving the naked resident “was not investigated. No abuse investigation was sent to the department.” The Administrator also stated that the incident “was not investigated [or] reported to the department.” This investigation was conducted after a review of records and interviews.
