  • The state investigators determined that the nursing home “failed to report an allegation of abuse to the State Survey Agency timely for [one resident] reviewed for abuse.” A review of the Facility Investigation dated May 27, 2019, revealed that the resident “reported an allegation of inappropriate contact to a Certified Occupational Therapy Assistant.”

    The Therapy Assistant “immediately reported the incident to the Administrator, Director of Nursing, and the Physician.” The resident “alleges the incident occurred the morning of May 25, 2019 but [they] did not report it to the facility until May 27, 2019.”

    The Physician examined the resident at 12:30 PM on May 27, 2019, and there were “no obvious physical injuries or conclusive findings discovered.” The resident “was transferred to the local hospital for further examination by a Sexual Assault Nurse Examiner and no clinical findings of an assault were discovered.”

    The facility “reported the incident to the State Survey Agency on May 27, 2019” at 3:23 PM, which was “six hours and thirty-eight minutes after the facility was aware of the allegation.” The facility Administrator confirmed that they had “failed to report the allegation” until six hours and thirty-eight minutes after they were aware of the incident and “failed to follow facility policy.”

    This investigation was conducted through interviews, a review of facility Investigation Documentation, and a review of medical records and facility policies.
