  • Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 date July 18, 2019
  • The state investigators determined the nursing home " failed to protect a cognitively impaired resident from being slapped by a staff member.” A review of the resident’s Care Plan indicated that the resident “sometimes makes inappropriate sexual advances toward staff and other residents. The goal of the Care Plan reads that [the resident] will not make inappropriate advances toward staff and other residents for the next 90 days.”

    An Initial Allegation Report, dated January 28, 2019, revealed that a Nursing Aide “was the accused individual and the details read [that it was] ‘reported to the supervisor by [another Nursing Assistant, that the allegedly abusive Nursing Assistant] was providing care to the resident.’” After completing care, the allegedly abusive Nursing Assistant lowered the resident’s bed. At that time, the resident put his hands between the Nursing Assistant’s legs and the Assistant “struck out, hitting the resident and stated, ‘don’t touch me.’”

    The allegedly abusive Nursing Assistant told the other Assistant that while providing care, the resident “put his hand on her and ran it down the front of her, almost between her legs. Without thinking, [the allegedly abusive Nursing Aide] hit him as hard as she could with her fist.”

    The Nursing Assistant stated that “she felt bad after she did it and had gone back later to make sure he was not bruised or hurt.” The abusive Nursing Assistant “reported that after she hit him, [the resident] looked like he had seen a ghost, and some people would call that abuse, but he was sexually harassing [the Assistant].”

    Documentation shows that the nursing home “became aware of the incident” on the same day the incident occurred.
