  • The state investigators determined that the facility “failed to ensure a thorough investigation of resident-to-resident abuse and missing jewelry for two random sampled residents” in completing the survey. A record review revealed that the facility completed an investigation “into their inappropriate touching (sexual abuse) allegation.”

    The investigative report documented that the “facility learned from a family member that [the resident] alleged [another resident] touched him/her inappropriately on July 12, 2017, [when they were] sitting together at a meal in the main dining room.” The document says that “the facility initiated an investigation into the allegation.”

    The report indicates that “staff did not allow the residents to sit together at the facility and initiated an investigation.” The staff interviewed the resident alleging sexual misconduct “regarding the allegation and believed [the other resident] did not touch him/her inappropriately on purpose.”

    The report indicates that both residents are “alert and oriented.” The reporting resident “insisted on staff allowing him/her to sit with [the aggressive resident]. The Executive Director or designee “will check with [the allegedly assaulted resident] every day to ensure the resident is free from sexual/physical/verbal abuse.”

    The surveyors conducted interviews with the dietary staff who “worked in the dining room on the day of the incident. They all denied any knowledge of the alleged incident. The facility failed to provide any additional documentation regarding the investigation.”

    The facility did not interview the [allegedly aggressive resident] regarding the allegations; Nurse’s Notes regarding the incident to show staff knew of the allegation; social service notes regarding the incident to show staff monitored the residents and ensure each resident’s safety.”

    The nursing home did not develop and implement “interventions on each resident’s Care Plan to direct the staff on how to monitor the residents [or have any] documentation of any [comprehensive] body assessment on [the abused resident].”
