The Most Common Causes of Nursing Abuse are linked to Staff Quality

Our eastern Kentucky nursing injury lawyers have witnessed a rapid decline in the quality of nursing care. The failure corresponds to the influx of for-profit companies and government budget cuts toward vital funding nonprofits use to compete and provide the type of care residents deserve. Some nursing centers reduce their overhead by eliminating many staff members from the roster. However, reducing staff levels too far can cause caregivers to be overworked and rushed when trying to provide care to many patients under the staff's care.

While there are some exceptions, most cases of neglect are entirely unintentional. The people responsible for the victim's wellbeing need to prioritize patients and provide attention to those in the most significant immediate need and may forget about others. When this results in an injury, the facility may attempt to hide the problem, making the situation even worse. Here are the most common causes of nursing neglect and types of abuse that might require legal action.

  • Failure to supervise patients – When staff fails to monitor patients with heightened health risks when they stand, walk, sit, or eat, the resident could be severely injured. It is essential that patients at risk of falling not be allowed to move around without supervision. Patients who require assistance while eating must have someone present during meals.
  • Non-consensual sexual contact (sexual abuse and emotional abuse)
  • Medication errors (failure to provide proper care) -- A combination of multiple prescriptions and a rushed nurse may lead to improper medication treatments. While these errors are widespread, most mistakes are benign, with only minor discomfort resulting from the misapplication of medicines. However, some drug interactions or overdoses may be fatal. The senior home facility needs to be held accountable when such errors lead to serious medical complications or death.
  • Resident-to-resident and staff-to-resident physical abuse could lead to severe injuries and the need for medical treatment.
  • Presence of clutter or unclean environment -- Understaffed nursing centers often cut corners to keep rooms and common areas clean and free of objects that could pose a trip hazard or broken bone. Patients live in rooms where their linens are not changed regularly
  • Unsanitary conditions – Denying residents access to hygiene assistance could expose patients to contaminants. This failure usually results in the spread of infection and possibly wrongful death.
  • Theft of the patient's property or medications is considered financial abuse
  • Failure to meet nutritional needs (home neglect) -- The patient's health history and individual needs must be considered when implementing a personalized treatment plan. Nutrition is an integral part of such a plan. Certain foods may interact with medications. The patient's allergies must be considered when serving their meals. Understaffed facilities may attempt to streamline the foodservice and ignore the individual's specialized care. In some cases, patients have gone without meals or suffered from dehydration because there were not enough staff members to serve all home care
