The state investigators determined that the nursing home failed to report an allegation of abuse involving two residents to the Department (CDPH – California Department of Public Health) within twenty-four hours of the incident and failed to submit the results of its investigation of the allegation of abuse to the Department within five days of the incident.”
It was determined that “these failures prevented the Department from investigating the allegation of abuse and had potentially placed residents at risk for abuse.”
A review of a resident’s clinical records and Social Services Director’s Notes dated May 30, 2019, at 1:30 PM revealed that a witness had seen “the resident ram her wheelchair against another resident and doing so until the other resident was moved.” The resident “then started cursing at everyone, yelling and screaming.”
A Social Services Director stated that “she had completed a reported incident and faxed it to the California Department of Public Health. However, a report regarding the incident involving [both residents] was not received by the Department.” The Director confirmed that “there was no additional documentation that indicated she spoke to someone at the Department if the report had been received or not.”
The “facility failed to provide lower dentures to [one resident] reviewed for assistive devices. This failure had the potential to contribute to [the resident’s] episode of choking on food.”
The resident’s family member stated that the resident had lost their lower dentures in the previous months, and the “facility would not replace or reimburse [the resident’s] missing dentures.” As a result of not having dentures, the resident “choked on solid food because she could not chew properly without her dentures.”
The investigators interviewed the resident, who stated that “she wanted to have her teeth back because she found it harder to [eat] food and had choked twice.” The Director of Social Services stated that “she did not know [that the resident] had a problem with her dentures.”
