The state investigators determined that “the facility failed to ensure the right to be free from abuse was provided for [one resident] reviewed for abuse. The facility did not prevent [the resident] from being verbally and physically abused by [a Certified Nursing Assistant (CNA).”
The CNA told the resident “not to touch her with those ‘shi**y’ hands’, and they need to have the hospital to ‘check your brain’ while providing incontinent care.” Another CNA “did not report immediately when [the allegedly abusive CNA] verbally abused the resident.” Additionally, the allegedly abusive CNA sprayed the resident “with cold water, causing him to jump.”
A review of the severely, cognitively impaired resident’s most recent MDS (Minimum Data Set) Assessment revealed “disorganized thinking.” The resident “was incontinent of bowel and bladder and required extensive assistance with activities of daily living. There were no behaviors noted.”
A review of the resident’s Care Plan revealed that the resident “had the potential for behavior problems due to being fixated on bowel issues, [who] frequently complained of either being constipated or having diarrhea related to a disease process due to [their medical condition].”
A Provider Report indicated that on October 11, 2018, at 3:30 PM, the resident “had a fall and [the other CNA assisted the allegedly abusive CNA] with getting the resident up from the floor. It was said to [the reporting CNA by the allegedly abusive CNA that ****] was everywhere and the resident knew what he was doing.”
The report indicated that the allegedly abusive CNA told the resident not to touch her using the words noted above and that the resident needed to have his brain worked on at the hospital. The report indicated later, “in the shower room, [the allegedly abusive CNA] sprayed cold water on [the resident’s] body.” That CNA was “suspended, then terminated after the investigation.”
