  • Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 date May 25, 2018
  • The state investigators determined that the nursing home “failed to follow its policy to ensure [one resident was] free from financial abuse.” A Certified Nursing Assistant used the resident’s “debit card several times without permission. This deficient practice resulted in [the resident] being a victim of financial abuse with a loss of $1200.”

    A review of the resident’s MDS (Minimum Data Set) Assessment indicated that the resident “had no impairment with cognitive skills (thought process) and the ability to make decisions.” The Director of Nursing stated that on February 15, 2018, the resident “approached the facility’s Admission Coordinator and asked for assistance [regarding] a bank statement. The Director stated it was reviewed with [the resident], and there was up to $1200 missing from the resident’s account.”

    The Director stated that the resident “had not authorized any charges or removed the money from the account himself. The Director stated once she was informed about the incident, she started an investigation [and] reported the incident to the ombudsman (patient advocacy), the police, the Department of Public Health, and the CNA Board of Certification.”

    A report indicated that the CNA “was identified by some of the local merchants as the individual fraudulently using [the resident’s] debit card. The summary indicated the local police department and ombudsman were notified, and [the resident] would be reimbursed by the debit card company once the Police Department finished their investigation.” The Admissions Coordinator stated that “she became suspicious when [the resident] was receiving frequent letters from the bank.”

    The Coordinator stated that when the resident “came to her with his concern, she was alarmed by the amount of money that was taken from his account.” The Admissions Coordinator stated that the resident “denied making the bank transaction charges, especially from cell phone stores, and the Department of Motor Vehicle.”

    The Admissions Coordinator was able to identify the email address “attached to the account number used for many transactions.”
