- Failure to Ensure That Every Resident Is Free from the Use of Physical Restraints Unless Need for Medical Treatment – citation #F604 date December 20, 2018
The state investigators determined that the nursing home “failed to document and indicate a medical diagnosis/symptom for the use of restraint for [one resident].” The surveyors observed the resident on the morning of December 17, 2018, “in her wheelchair with a lap cushion, propelling in the hallway.”
The state survey team reviewed the resident’s Physician’s orders and MDS (Minimum Data Set) Assessment that show that the severely, cognitively impaired resident had a documented restraint of a lap cushion used “because of resident safety following multiple falls related to Alzheimer’s/dementia.”
The resident’s Physical Restraint/Enabler Assessment documents that the restraint is to be used when the resident is to avoid “falling forward, sideways, sliding down, and slumping.” An interdisciplinary team Progress Note documents that the resident “took the lap cushion off and attempted to take clothes off and slid to the floor. The lap cushion was replaced with a different lap cushion.”
A Licensed Practical Nurse (LPN) stated that the resident “has a lap cushion due to multiple falls [and] was able to take the last lap cushion off and then fell out of her wheelchair.” The LPN stated "so now [the resident] has a new lap cushion that she has not been able to take off yet.”
In a separate summary statement of deficiencies dated January 17, 2018, the facility “failed to ensure [one resident] was not physically restrained.” On January 16, 2018, 10:15 AM, the resident stated that they were “held down by a Certified Nursing Assistant (CNA) to obtain a urine sample via straight catheterization.” The resident stated that the CNA “held my legs in place and put her body over mine, so all I could do was hit her back.”
The CNA verified approximately forty minutes later that the resident “cannot really move her legs at all. I held them open for a straight catheterization. I did not hold her hands but blocked her from contaminating the site with my upper body.” The CNA did confirm that the resident “screamed and said, ‘No.’” This investigation involved a review of medical records and interviews.
