Failure to Protect Each Resident from All Forms of Abuse, Physical Punishment or Being Separated from Others - citation date July 1, 2017
The investigator stated the "facility failed to ensure four residents were free from abuse to include resident-to-resident abuse and staff abuse of a resident." The investigators determined that "a situation in which the facility's noncompliance with one or more requirements of the participation has caused, or had the likelihood to cause, serious injury, harm, impairment, or death to residents."
Documentation shows that the "facility failed to adequately detect residents from allegations of sexual and physical abuse and also failed to investigate and report the allegation to the appropriate agencies." The deficiency affected four residents.
A Registered Nurse documented that one resident told her that another resident "hit him in 'the private,' which subsequently caused a hematoma to his right testes." The Registered Nurse told the former Director of Nursing and the Administrator. However, the allegation of "sexual abuse had not been investigated and had not been reported."
A review of the Follow-up Urology Consult Notes shows that the patient was seen by the doctor to "go over a recent ultrasound to evaluate a scrotal mass. It was initially thought to be possibly hydrocele [an accumulation of serous fluid]. However, the current reading mentions possible hematoma."
Failure to Report and Investigate Any Acts or Reports of Abuse, Neglect or Mistreatment of Residents - citation date July 1, 2017
The investigator stated that the nursing home "failed to investigate and report allegations of abuse" that led to an Immediate Jeopardy at the facility as documented above. The Director of Nursing revealed that "he became more aware of the grievances for [the resident] on June 26, 2017, and that he investigated the [incident and] had removed the CNAs that were named in the agreement, from working on the same unit as [the resident]."
Even though the Director of Nursing had interviewed the witness and notified the resident's Physician and responsible party and immediately educated the staff on abuse, he "had not reported the grievance to the State Survey Agency" as required by law.
Failure to Provide Every Resident an Environment Free of Accident Hazards and Provide Adequate Supervision to Prevent Avoidable Accidents - citation date July 1, 2017
The facility "failed to ensure a safe smoking environment for [a resident] and failed to ensure coffee temperatures were within safe parameters to prevent burns."
Failure to Develop, Implement and Enforce a Program That Investigates, Controls and Keeps Infection from Spreading - citation date July 1, 2017
The facility "failed to maintain an infection control program that demonstrated ongoing surveillance, recognition, investigation, and control infections to prevent the onset and the spread of infection."
During an interview, and Licensed Practical Nurse (LPN) as the facility's Infection Control Designee stated "I do not have surveillance books or logs. I look who has antibiotic orders, and I give that list of the Director of Nursing." The LPN also stated "I never received training. When I asked anyone, no one could tell me whether I was doing things right, so, I kept doing things away I was doing it."
