  • Failure to Ensure That Every Resident Is Free from the Use of Physical Restraints Unless Need for Medical Treatment – citation #F604 date December 18, 2017
  • The state investigators determined that the nursing home “failed to attempt the least restrictive restraint measures [before] applying the hand mitten restraint to [one resident]. This [deficient practice] had the potential to cause injury and effect [the resident’s] psychosocial well-being.” The investigators reviewed the facility’s policies and procedures titled: Restraints and Position Change Alarm Use from November 2017, that reads in part:

    “A physical restraint is defined as any method or physical or mechanical device, equipment, or material that is attached or adjacent to the resident’s body, which cannot be removed easily by the resident and restricts the resident’s freedom of movement or normal access to his/her body.” When physical restraint is used, the facility must use the least restrictive restraints for the least amount of time.”

    The state investigators observed and interviewed the resident at the resident’s bedside. During that time, the resident was “observed in bed, awake, wearing bilateral hand mittens.” The resident stated that “she liked to have the mittens on because it prevented her from scratching her wounds.” The resident stated that “she wore them while sleeping and was about to take a nap.”

    A review of the resident’s Care Plan Conference Records shows that the resident’s family “was aware of the situation and the facility would continue to monitor [her]. A further review failed to show the facility attempted interventions, including less restrictive alternatives.”

    Additionally, the resident’s medical record “failed to show a pre-restraint assessment was completed and failed to show any less restrictive alternatives were attempted to treat the medical symptom but were ineffective prior to applying the hand mittens.”

    A Registered Nurse stated that the resident wore the mittens to avoid removing her wound dressings at night and verified that “a pre-restraint assessment was not completed” before the application of using the mittens began.
