The state investigators determined that the nursing home “failed to ensure a resident was free from abuse by failing to implement the facility’s Abuse Policy and immediately suspending a staff [member] accused of physical and verbal abuse.”
A review of the Facility Abuse Investigations “revealed an allegation of physical abuse investigation was entered into the State Reporting Database on April 2, 2018, for [the resident].” The documentation revealed that a Certified Nursing Assistant (CNA) “was accused of physical abuse of the resident. A review of the documentation revealed the resident and her family reported to the facility that [the CNA slung the resident’s arm] away from her, as the resident attempted to touch her.”
The documentation revealed that the CNA “was suspended pending investigation and was terminated after the completion of the investigation.” A further review of the investigation revealed: “an allegation of emotional abuse was entered into the state reporting database [the following day for the same resident].”
That documentation revealed that “the resident’s responsible party reported to the facility that [the same CNA] had gotten into the resident’s face and yelled at her saying, ‘you;re not blind and you’re not death.’” The documentation also revealed that “the resident’s responsible party was in the resident’s bathroom at the time of the incident, and [the CNA] was unaware.”
The resident stated that as “she got up, she did not have anything to hold onto, lost her balance, and started falling.” The statement revealed that when the resident attempted to grabbed the CNA, the CNA threw the resident’s arm away from her.
In a statement dated April 3, 2018, the resident reported that she was in “her wheelchair, got up from the wheelchair, and had bad balance.” The statement revealed that when the resident attempted to grab the CNA, “the CNA threw [the resident’s] arms back.”
