The state investigators determined that the nursing home “failed to ensure the Abuse Policy was implemented effectively to prohibit neglect when a Certified Nursing Assistant (CNA) did not perform necessary care to [one resident when the resident] was left with urine-soaked bedding for a length of time.”
Another resident also was neglected “when left unattended in bed. These failures had the potential for physical and psychosocial harm for [the first resident], and potential physical harm for [the second resident].”
The Director of Nursing told the surveyors that “she knew of complaints made by the resident’s family and staff members of [a CNA's] neglectful behavior.” The Assistant Director of Nursing also confirmed that the CNA “would leave his assigned group of residents unattended, including [both of these residents].” The Assistant Director stated that on February 16, 2017, the CNA “left the floor unattended for a long period of time without informing the supervisor [and that] several of his assigned residents were left soaking wet.”
The Assistant Director went on to say that the CNA “left the resident’s needs unmet and during [the CNA's] absence, the second resident was found with his right leg caught between the bed rail and the mattress, which caused a bruise on his right leg.”
That resident’s clinical records indicated that the resident “requires total assistance of staff for bed mobility and transfers. The resident was wheelchair and bedbound and had advancing age with fragile skin.” The resident “was found to have his right leg stuck between the bed rail and mattress, resulting in discoloration of the skin. The incident was unavoidable secondary to the resident’s condition and poor safety awareness.”
A review of the facility’s policy and procedure titled: Abuse Prevention Program dated November 2016, indicated “…to ensure the health and safety and comfort of residents by preventing abuse and mistreatment. The facility does not condone any form of resident neglect and develops facility policies, procedures, training programs, and systems [to] promote an environment free from abuse and mistreatment.”
