  • The state investigators determined that the nursing home “failed to investigate and report an allegation of mistreatment, neglect, and abuse to the Administrator of the facility or his designee (Abuse Coordinator).” Additionally, this deficient practice failed to “report this allegation, conduct a thorough investigation, and to prohibit the alleged perpetrator access to the facility at the time the allegation was reported.”

    The facility “demonstrated a lack of action and commitment to protect [one resident] and other vulnerable residents from the possibility of continued abuse.” An interview with the Unit Manager indicated that the resident “had a stage IV pressure ulcer on his left ischium, measuring 2.0 cm x 4.0 cm x 1.8 cm. Currently, the facility is using a wound vac to treat the wound.”

    The investigators interviewed the resident who stated that in mid-June, “there had been an incident with a male Certified Nursing Assistant (CNA) in which the CNA ripped his brief off and tore his skin on his buttocks and the back of his thighs. He identified [the employee] and stated that he knew it happened during that time because he could feel how much force the CNA used when he pulled the brief from between his legs.”

    The resident stated during the incident, he and the “CNA were having an argument about the size of brief the CNA was going to put on him. He stated he wanted the CNA to put a larger brief on him (green/medium or yellow/large) than the one he brought to the room (blue/small).”

    The resident stated that the CNA “told him he could not put on a larger brief on him because the briefs are based on the weight of the resident, and he requires the smaller size. The resident told the CNA he did not care the brief was larger than what was recommended; he wanted at least a medium. He stated he was trying to calm himself down as he was saying to himself to just shut up, to shut up, when the CNA told him he was rude and should not speak to him that way.”
