These penalties include a $48,075 fine on April 30, 2018, a $122,005 fine on May 11, 2017, and a $82,056 fine on February 16, 2017, for a total of $252,136. The state investigators determined that the nursing home “failed to ensure residents were free from neglect for [one resident] reviewed for discharge. The facility allowed [the resident] to discharge from the facility against medical advice (AMA), knowing he was evaluated and determined to lack the decisional capacity to make complex medical decisions and to refuse placement and failed to have the resident’s mental status re-evaluated.”
This deficiency is a repeat from a previous recertification survey. The deficient practice resulted in the resident “going home alone where he was unable to take care of himself and, as a result, died.”
The resident was released to a private home or apartment with no home health services. Upon discharge, the resident suffered from numerous medical conditions including an abnormally fast heartbeat, essential hypertension (high blood pressure), low potassium levels, and pain.
The Social Services Director stated that “she was involved with the discharge planning of the resident [and] called Adult Protective Services” before the resident “left the building to them know about his unsafe discharge and that he was signing himself out [Against Medical Advice].”
The Social Services Director stated that the resident had a nephew. However, he refused to answer or return the facility’s phone calls and refused to work with staff during the discharge planning.” The Director confirmed that the facility staff told the resident “to his house after he was discharged and called the locksmith to have the locks changed because [the resident’s nephew] had the key.”
