The state investigators determined that the nursing home “failed to develop written abuse, neglect, and exploitation policies which include guidance to staff in handling evidence which could be used in a criminal investigation.” This lack of policy created a failure and “how to investigate different types of alleged violations, providing room or staffing changes to protect other residents, and investigating to determine the cause of the abuse, neglect, or exploitation.”
The nursing home “failed to develop and implement a policy to include training for current new staff regarding Abuse, neglect, and exploitation related to unauthorized photographs or video recordings of residents in social media networks.”
The investigators interviewed the administrative staff who revealed that “the facility had completed the HIPAA (Health Insurance Portability and Accountability Act) training that included the confidentiality of resident healthcare information which included photographs/videos within the last year for each employee.”
The administrator stated that “the training was not specific to the Centers for Medicine Survey and Certification Letter.” Approximately one third of the employees working at the facility had not received appropriate training and did not attend the meeting involving abuse, neglect, and exploitation.
