The state investigators determined that the nursing home “failed to ensure each resident has a right to be free from verbal, sexual, physical, and mental abuse, corporal punishment, and involuntary seclusion.” The investigation involved three residents involved in two separate occasions.
One resident “who was involved in the previous unprovoked incident with [a second resident slapped the third resident] across the face unprovoked, leaving red marks.” A review of the resident’s medical records indicated that the resident resided on the Chronic Confusion and Dementing Illness Unit.
The incident was documented in the Nursing Progress Notes at 11:00 AM on July 9, 2016. The document revealed that “staff observed the resident with both hands on the left wrist of another resident. The resident and another resident sat in recliners in the lounge area on the Chronic Confusion and Dementing Illness Unit. The staff redirected [the aggressive resident] and moved the other resident.”
The incident report revealed that the aggressive resident “twisted the other resident’s left arm with his/her hands.” The Director of Nursing services assessed the other resident’s left wrist and observed an approximate 1.0 cm red/purple area on the left wrist.”
The assaulted resident’s Nursing Progress Notes documented that the staff “applied ice to the [severely, cognitively impaired] resident’s wrist and did not observe swelling or deformity.” The nursing staff sent a fax of the Physician at 3:00 PM that day reporting that the aggressive resident “got agitated when another resident yelled out and [the aggressive resident] grabbed the other resident’s arm with a twisting motion.”
The surveyors determined that the injured resident had a 1.0 cm x 1.0 cm dark purple area resembling purpura to the left wrist.”
