- Failure to Protect Every Resident from All Forms of Abuse Including Physical and Sexual Assault, Physical Punishment, and Neglect by Anybody – citation #F600 date January 10, 2019
The state investigators determined the nursing home "failed to protect the right to be free from physical and verbal abuse for [two residents] who were reviewed for abuse.” In one incident, a Nursing Assistant “verbally cursed and insulted [a resident], and physically grabbed [the resident] by the genitals when she forcefully transferred the resident from the bed to a wheelchair.”
The injured victim “reported he experienced embarrassment, fear, and anxiety, created by the verbal and physical abuse inflicted on him by [the Nurse Aide]. Additionally, the facility failed to prevent [the Nurse Aide] from verbally abusing [another resident] as she cared for the resident.”
In the second case, the abused resident “was visibly shaken and scared as a result of this abuse, requiring a staff member to sit with the resident for fifteen minutes to calm her nerves.” The investigators determined an Immediate Jeopardy began on December 12, 2018, when the Nurse Aide “used profanity and insults and grabbed [one resident] by the genitals when transferring the resident from his bed to the wheelchair.”
The Administrator and Director of Nursing stated they accused the Nursing Aide of abuse. The Aide reported that “ she never used profanity toward [the resident] and she was only trying to motivate the resident to do as much for himself as possible.”
The Nurse Aide “commented she had never been accused of abusive behavior before, so she quit her job.”
