The state investigators determined that the nursing home “failed to implement the reporting and investigation component of the abuse and neglect Prohibition policy after becoming aware of [a resident’s] family’s allegation of neglect on March 22, 2018. Further, the facility failed to develop a policy addressing how investigations of allegations of abuse or neglect should be conducted.”
The State Survey Agency received a complaint on April 16, 2018, regarding a resident “involving a concern related to the facility’s failure to address the resident’s pain or order an x-ray following a fall in February 2018.” Along with the complaint, “the State Survey Agency received a letter from [the resident’s] family, dated March 11, 2018. This letter was addressed to both the State Survey Agency and the facility.”
The letter indicated that the resident “sustained a fall in February 2018, and the facility waited a week after constant complaints of pain to order an x-ray, which revealed a leg fracture. In the letter, the family also alleged neglect (neglectful) action had occurred.”
The state investigators interviewed the Administrator/Abuse Coordinator, who “confirmed the facility had received a copy of the letter from the resident’s family on March 22, 2018.” The coordinator confirmed that the letter indicated the family had concerns of neglect stating that “it does state the word ‘neglect.’” The Coordinator also confirmed that the allegation of neglect “should be reported but explained he had not interpreted the letter as an allegation of neglect when he read it.”
The Administrator/Abuse Coordinator stated, “true allegations of neglect should be reported to the State Survey Agency within two hours of having knowledge of the allegation [and that] an allegation of neglect [is when] someone alleges their loved one has not received something they should have.”
The Administrator stated that they had not reported the incident to the State Survey Agency as required by law and “agreed that the allegation should have been reported.” The Administrator also said that “they had not interviewed the staff who cared for him/her during the time of the concerns.” The Administrator stated that “he had not interpreted the letter as an allegation of neglect, but he probably should have.”
