The state investigator determined that the nursing home “failed to ensure residents were provided with a safe environment free from abuse, seclusion, retaliation and neglect.” The investigation involved eleven residents.
In one case, a resident “was involuntary secluded (confined) in her room twice by the prior Administrator and prior Director of Nursing. The first seclusion incident lasted for more than four days and occurred after [the resident] gifted a Gideon Bible to a facility employee and was verbally scolded an accused of not following facility rules.”
The “second seclusion incident lasted for more than three days and occurred after [the resident] was speaking with friends in the dining room regarding the hospitalization of her roommate and was falsely accused of divulging protected health information. The facility practice resulted in the violation of [the resident’s] right to be free from verbal abuse, the right to be free from involuntary seclusion, and was subjected to eating meals in her room, prohibited from participating in activities and eating in the dining room with her friends.”
The investigators determined that the treatment caused the resident “to suffer mental anguish, emotional distress, and humiliation.”
The previous Director of Nursing and previous Administrator involuntarily secluded the second resident “in her room for greater than seven days because of episodes of coughing.” The former Director “did not submit referrals for Physician evaluation, laboratory specimens, or diagnostic testing to confirm the infectious disease in [the second resident].”
The “facility practice resulted in the violation of [the second resident’s] right to be free from seclusion and verbal abuse.” Instead, this resident “was subjected to eating meals in her room, prohibited from participating in activities, and eating in the dining room with her friends. This treatment caused [the second resident] to suffer mental anguish, emotional distress, and humiliation.”
A third resident “was subjected to retaliation when his motorized wheelchair was taken away from him for a week by the previous Director of Nursing as a form of punishment for not following the facility rules. The facility practice resulted in the denial of [this resident’s] right to use his personalized motorized wheelchair, restricted his independent mobility, his ability to maintain his daily routine of activities, and caused frustration and humiliation.”
