  • Failure to Protect Every Resident from All Forms of Abuse, Physical Punishment, and Being Separated from Others – citation #F223 date March 31, 2017
  • The state investigators determined that the nursing home “failed to ensure residents were free from abuse by not following the facility smoking supervision policy.” The investigation involved a resident whose medical records indicated “psychotic-like behavior.” The patient is “noted to have an occasional outburst but otherwise is stable. Although the facility was only able to provide minimal behavior monitoring for [the resident, the resident] was being tracked for behaviors listed as talking to people not present.”

    The resident also had “outbursts of anger toward others” on numerous occasions over two months. A note documented Outburst of Anger Toward Other stated that the resident “was leaving the smoke room when he approached [another resident] and stuck out his tongue at [that resident]. Intervention attempted is listed as ‘No.’”

    It was documented that there was “no behavior monitoring record” involving the incident. An Incident Report Form submitted to the Illinois Department of Public Health made notification of a resident-to-resident altercation that had occurred on October 26, 2016, at 4:30 PM between the two residents listed above in the smoking-room.” A Certified Nursing Assistant (CNA) and Licensed Practical Nurse (LPN) who also serves as the MDS (Minimum Data Set) Coordinator revealed that the assaulting resident “reported being hit four times on the jaw and the staff noted blood present on [that resident’s] mouth and neck.”

    The resident’s SBAR (Situation, Background, Assessment, Recommendation) and Progress Notes for the injured resident shows that the resident “had a small abrasion that was cleansed, but unable to be measured due to it being inside [the resident’s] mouth.”

    A subsequent resident-to-resident altercation took place on March 29, 2017, in the smoking-room, when the aggressive resident “was upset over [a] cigarette butt.”
