The state investigators determined that the nursing home “failed to provide safety for [a resident] during transportation via the facility van. This failure resulted in [the resident] falling out of the facility van in a wheelchair and sustaining two fractures (the neck and finger), two facial lacerations, and a forehead hematoma.”
The surveyors were provided an incident report for the resident that documents that the cognitively intact resident “sustained a fall on April 23, 2018, at 10:46 AM, which resulted in [the resident’s] injury of the second cervical neck fracture, right index finger fracture, and multiple contusions/abrasions to [the resident’s] face and limbs.”
The resident’s medical records and MDS (Minimum Data Set) Assessment indicates that the resident has “bilateral lower extremity impairment requiring a walker or wheelchair for ambulation.” The resident is also a high risk for falls.
The Trauma Surgery Discharge Summary from the Acute Care Hospital dated April 25, 2018, indicates that the male resident was admitted to the facility after an accident involving the resident’s “wheelchair rolling off the van ramp during a nursing home transport and falling off of the wheelchair, sustaining [injuries].”
The Maintenance Director said that, “the person who usually drives the van was not at the facility, so [the Maintenance Director] was asked to drive the van.” The Director stated that they were “shown how to get the residents in and out of the van with their wheelchairs but was not [told] anything about whether or not to leave the side door open or closed.”
The Director stated that the resident had been facing the front of the vehicle and that the Director had “unlocked the right-side break and then the left side brake and when [the Director] undid the left brake, [the resident] went rolling out the side doors of the van.”
The Director said that there were no seatbelts or locks on the resident’s wheelchair before the resident “rolled out of the van.” The Director stated that they found the resident face down on the ground.
The facility Administrator was unable to find “any instructions regarding transferring residents in and out of the van and no instructions on when the side or back door should be opened or closed.”
