The state investigators determined that the nursing home “failed to implement its policy, the Care Plan Conference recommendations, and thoroughly investigate and protect [two residents] from [a third resident’s] alleged verbal and physical sexual abuse.”
On September 11, 2018, the sexually aggressive resident asked the other resident “to have sex with him, and on September 13, 2018, [the sexually aggressive resident was found in the other resident’s] room with her adult brief and pants off, while [the aggressive resident] was standing over [the female resident] and the room door was closed.”
As a result of a failure of the facility’s system “to implement its policies and protect residents from [the aggressive resident’s] sexual abuse, two residents were at risk for sexual abuse.” The state investigators determined an Immediate Jeopardy situation existed which could lead to serious injury, harm, impairment, or death to the resident.
The facility “failed to implement interventions to prevent further harm for [one resident].” The “deficient practices placed the residents at risk for harm or injury.”
The state investigators observed a Licensed Vocational Nurse in the resident’s room where “there was no padding observed on the side rail for [the resident’s] bed.” A review of a Physician’s order indicated that the nursing staff was “to apply pads to the side rail secondary to [the resident’s] seizures.”
The investigators reviewed the facility’s policy and procedure titled: Proper Use of Side Rails from May 2015. The report indicates “side rails with padding may be used to prevent resident injury in situations of uncontrollable movement disorders.”
